This consent form describes important matters with regards to the DNA Paternity/Maternity test services offered by the Company.
[ Terms and Conditions ]
<About the Non-Legal Paternity/Maternity/Single Profile/Relationship Test>
- 1. This service provides genetic information and determines the biological relationship of the participants for DNA Paternity/Maternity/Single Profile/Relationship Test using the DNA obtained from the samples collected from or submitted by the participants.
- 2. This service is only for the purpose of confirming Paternity/Maternity/Single Profile/Relationship for private use/personal knowledge. Hence, the results cannot be presented as legal document or used in court for evidentiary purposes.
- 3. The company shall not accept any applications wherein the applicant and/or participants use aliases/false name or are anonymous. If any falsification of identity and/or unauthorized application has been made, the applicant must take full responsibility.
- 4. For non-legal DNA testing, the applicant's age must be 18 years old and above.
- 5. Before availing of this service, the applicant must obtain the consent of all the participants in the test. If participant is underage or physically/mentally incapable, the consent must be given and signed the parent or legal guardian.
- 6. The laboratory and the company assume no responsibility for any incorrect, incomplete, or misspelled information in the application form and DNA sample envelopes. If needed, the Company shall require additional documents. The final analysis report shall be based on the information provided by the applicant, and the company shall not accept modifications or changes one the analysis report has been released.
- 7. For applicants ordering home kit, the Company and laboratory shall not be responsible for the condition the sample before their arrival at JPPH Henes Collecting Services (DNA Genes PH) and/or DNA JAPAN, Inc. This includes the improper collection, storage, and shipping of sample by applicant and/or participants, in which the testing of samples may be delayed and/or the results may be not be obtained.
- 8. With regards to non-standard samples, the company shall confirm with the applicant that the sample will not be returned and will be discarded after analysis.
- 9. While the procedures undertaken are appropriate and correct, nevertheless, there are instances wherein the test results might not be obtained due to genetic mutation, defect, and other scientific factors.
- 10. Despite the high value of accuracy, the results of the test are merely statistical, which is calculated based on the sequence of genes on biological meaning. The results are therefore not an absolute conclusion of filiation or non-filiation, inasmuch as the same is subject to the determination of proper judicial authorities.
- 11. The period within which the DNA test analysis is completed may be shortened or extended depending on the condition of the samples. The Company cannot guarantee the schedule of releasing the results in view of unavoidable factors. However, it shall be due not earlier than seven (7) nor more than twenty (20) business days from the date of the submission of the application, complete with the other requirements.
- 12. If the DNA samples submitted by the participants are insufficient for testing, a recollection/second sample shall be requested once and may be provided by the participants within fifteen (15) working days. An additional payment will be charged to the participant for courier service. However, in the case that the participants fail to provide the samples or cease/discontinue communication within this period, the test will be automatically canceled.
- 13. The DNA report must be claimed within five (5) days upon proper notification to the applicant. Personal information of the applicant and participants and the data shall be preserved for six (6) months after the DNA report has been released to the applicant and will automatically be deleted in our system after this period. However, depending on the applicant's and/or participant's circumstance, exemptions shall apply, provided the applicant informs the Company beforehand of the intended purpose for the DNA Application.
- 14. Once the personal information of the applicant/participants and data of DNA test results are deleted after the period stated in statement 13, the company shall not respond to any inquiries or requests in regards to the test service. In addition, personal genetic information may be used by the Company as anonymous data for research purposes.
- 15. The DNA test results might be different from what the applicant and participants expect, which may affect the family and the relationship between among its members. Please consider this before applying for the test.
< Application and Cancellation >
- 1. Once payment for the services is settled, the application for the DNA test will officially be processed and the samples will be sent out to the laboratory for the test proper. The test will not proceed unless payment has been completed or confirmed.
- 2. The Company shall require a reservation fee of ₱ 500 before the appointment, which must be paid in cash or through bank transaction. The amount shall be deducted from the total fee during the appointment.
- 3. For business trips, in addition to the test fee and service fee, the client shall shoulder transportation, airfare, food, and accommodation of the staff. Furthermore, the client shall make a deposit of 50% of the service fee in cash or through bank transaction
- 4. Regardless of the amount paid, reasons, and circumstances any payment made shall not be refundable. Such cases include: cancellation of participants, and delays in the testing schedule and/or releasing of the result.
- 5. The client is allowed to re-schedule the appointment within fifteen (15) business days. Beyond this, another reservation fee shall; be required.
- 6. This service is only available in the Philippines. Application form overseas will not be accepted. Please contact the company for receiving Homekit overseas and sending samples.
- 7.Homekit must be returned by the applicant within ten (10) business days from receipt. In the event, the return id made beyond this period, a fee of ₱ 2,000 shall be charged to the applicant to cover the cost of the kit.
- 8. In cases where there are intentional false declarations of relationship in the application form and submitted samples (excluding unintended errors), samples were obtained illegal alterations or modifications were done after the test application, the applicant and/or participants are members of or have close ties with gangs, extreme left terrorist organizations, and other unlawful organizations, or the mutual trust of the Company with the applicant has been compromised, the Company shall immediately cancel the test service. In whichever case, no refund shall be made.
- 9.The DNA test results/information can only be given to the applicant or the applicant's authorized representative. Except upon lawful orders from the courts of the Republic of the Philippines, the Company has the right to deny any request withhold permission to obtain the copy of the results, including but not limited to family members, police officers, lawyers, and physicians.
- 10.The Company prohibits the relaying of the test results and contents of documents through social networking sites, text messages, or phone calls.
- 11.The applicant shall make sure that any person, including but not limited to participants, family members, friends, and colleagues, will not abuse and/or harassed by phone, email, other means of communication, or in any matter altogether the staff of JPPH Genes Collecting Services (DNA Genes PH) and DNA JAPAn, Inc. The applicant shall indemnify JPPH Genes Collecting Services (DNA Genes PH) and DNA JAPAn, Inc. against all costs, claims, demands, expenses and liabilities of whatsoever nature that may arise from this service.
<Privacy Statement>
- 1. Any information given regarding the applicant and the participants in the DNA test shall only be used in this service. Under no circumstances will the information be disclosed to others, unless otherwise compelled by the law.
- 2. The court in Shinjuku-ku, Tokyo, Japan (district court/summary court) shall have exclusive jurisdiction over any dispute to the Company arising from this DNA test service.
<Exemption Clause>
The applicant and participants hold the Company free and assures no liability arising from any dispute between and among the participants in the test conducted. The
Company shall not be liable for any damages that will be caused by the results to anyone, be a participant in the test or not.
